dcmage Software License

This license is between Michał Sadurski (“the Licensor”, “we”) and the person or organisation that uses dcmage (“you”). By running or using dcmage, you accept it. If you do not accept it, do not use dcmage.

1. What this license covers

“dcmage” means the dcmage browser application served at app.dcmage.com, the dcmage container images published at ghcr.io/kiwiprojekt/dcmage-release, and every copy, version and update of them.

The macOS application distributed through the Mac App Store is licensed to you under Apple’s Licensed Application End User License Agreement, not under this license.

dcmage includes third-party open-source components. Each is licensed under its own terms, which are listed in the application’s Open-source licenses window and in the software bill of materials the application serves at /sbom.cyclonedx.json. Nothing in this license limits the rights those terms give you.

2. What you may do

We grant you a free, non-exclusive, non-transferable, non-sublicensable license to:

use the browser application at app.dcmage.com; and
install and run the dcmage container image for your own internal purposes, including commercial ones.

If you are an organisation, “your own internal purposes” includes use by your employees, your students and faculty, the contractors working for you, and the staff of companies or institutions that control you, that you control, or that share a controlling owner with you. You may run the image on infrastructure you control, or on infrastructure that a hosting provider operates for you and only on your behalf.

You may keep internal copies of the image, for example in a private registry, a mirror or a backup, as far as running it under this section requires.

3. What you may not do

Unless we agree otherwise in writing, you may not:

make dcmage available to anyone outside the users described in section 2, including as a hosted, managed or software-as-a-service offering;
sell, rent, lease or lend dcmage, or charge anyone for access to it or for use of it, whether directly or as part of another product or service;
publish or redistribute the container image or any copy of dcmage, for example on a public registry or download page;
remove, hide or change the dcmage name, logo, copyright notices, license notices or medical-device warnings;
modify, translate, decompile or reverse engineer dcmage, except where the law allows it regardless of this license;
work around a technical measure that restricts access to a feature, including the boundary between free and paid features.

4. Hosting dcmage for others

If you want to offer dcmage to users outside your organisation, host it for customers, or build it into a product you sell, write to [email protected]. That needs a separate written license, and we decide whether to grant one case by case.

5. Ownership

dcmage is licensed to you, not sold. We and our licensors keep all rights in dcmage, including copyright and trademarks, except the rights this license grants you.

6. Intended use

dcmage is not a cleared medical device and is not intended for primary diagnosis. The intended use and the medical-device disclaimer in the Terms of Service apply to every use under this license.

7. No warranty

dcmage is provided “as is” and “as available”, without warranty of any kind, express or implied, including fitness for a particular purpose and non-infringement.

8. Limitation of liability

To the extent the law allows, we are not liable for any direct, indirect, incidental, consequential or special damages arising from the use of dcmage or the inability to use it. This does not limit liability for damage caused intentionally, or any liability that cannot be limited by law.

9. Termination

This license ends automatically if you break it. When it ends, you must stop using dcmage and delete the copies of the container image you hold. Sections 5, 7, 8 and 10 continue to apply after it ends.

10. Governing law

This license is governed by the laws of Poland. If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live.

11. Changes

We may publish a new version of this license. A new version applies to releases of dcmage published after it takes effect. A release you already hold stays under the version it shipped with.
